Update
It's been a while since I posted anything but then, it's been a while since much of anything has happened. We did get the ruling in our favor from the EEOC, hired our attorneys and waited. The EEOC decided not to represent us. Why? Who knows - they don't have to give a reason. More than likely it's because they're overworked, understaffed and three women suing doesn't quite make headlines like a nationwide suit against Wal-Mart. Sad, but that's the way the bureaucratic cookie crumbles.
So we continue our pursuit with our attorneys. As I mentioned above, we are down to three women. Once the EEOC backed out, one of the women in our party decided she couldn't afford her portion of attorney fees. And yes, even though our attorneys are on a contingency fee (they get paid the big bucks if we win) we are still out approx. $20,000 up front to take this thing to court. Oh yes, you read that right. We were required to put down $5,000 retainer (which we split 3 ways) and I have no idea when the next deposit of funds will be required.
Our suit was filed in federal court and the defendents received notification somewhere around December 1st. They now have 30 days to respond. Last week I received notification that there will be a scheduling meeting in February which basically notified us of our magistrate judge and settlement judge and informed us that deposition scheduling will be occurring at this time if a settlement cannot be reached.
I'm not holding my breath.
We were notified by our attorneys that depositions will more than likely take place in the March or April time frame and that we will have to be present for this(two of us no longer live in the state).
I'll post more as I learn more.
